Best to see a specialist lawyer @Meowmy  your share could be put in a trust maybe.

Brother doesn't have to have anything to do with it.

@TAB hey tabby, trying to get better with MH. Mum can change her will any time. Especially with brother whispering in her ears. I just try to get better, more confident and healthier.🙏🙏🙏🙏 . Thanks for care and support

thet are asking you to agree to something that is very bad for you, so they must not have the power to cut you out,

A family provision claim in Victoria is a legal action that allows certain family members and dependents to request a greater share of a deceased person's estate. These claims are also known as: 
 
 
  • Testator Family Maintenance (TFM) claims 
     
     
  • Part IV claims, referring to Part IV of the Administration and Probate Act 1958 (Vic) 
     
     
  • "Contesting a Will" 
     
     
To make a successful claim, the claimant must: 
 
 
    • Be an eligible person 
       
       
    • Have had a close or blood relationship with the deceased 
       
       
  • Have received inadequate or no provision from the estate 
     
     
  • File the claim within 12 months of the date of death 
     
     
Eligible persons include:
  • The deceased person's spouse or partner
  • A child who was under 18 at the time of the death
  • A child who was under 25 and a full-time student at the time of the death
  • A child with a disability
  • A former spouse or partner who could have taken proceedings under the Family Law Act 1975 
     
     
The court can make orders in either the Supreme or Country Courts. However, the case-by-case nature of determinations makes it difficult to predict whether a claim will succeed or how much the order will be. 
 

If only children survive
The deceased, the assets are split evenly between them. This does not usually include step-children unless otherwise specified.

     The hierarchy is as follows:
Children of deceased
Grandchildren

     Where only children survive:
To children in equal shares.

..ie   do not sign anything and go see a lawyer

Hope you had a good day. I worked yesterday and work tomorrow. I will try to sort out leave in January for just over a week. You will get there, police check is pretty quick, and child check can take a bit longer.

 

Much planned for the week? I'm hoping to get to the pool tomorrow.

yes, Ive got both clearances now. I  got Certificate of Completion for course Friday, so thats something.

I should make a plan for this week as no apointments it seems. maybe go and buy some trees etc,finally went to local place they have a fair amount of stuff, nothing I  wanted though.I did get a mangy looking mint plant in tiny pot. it was root bound. I put it in 25cm pot and now its booming with lots watering and fertiliser. prob 3-4 x size it was a few weeks ago.

closest place for trees is only native trees but thats a start . would just have to work out where to put them.  they will be for shade from morning sun I think. the giant pines I had cut down used to block that out. They had roots 20 meters away in my septic tho and prob under neighbours yard as they water most days all year round, everything on my fence line healthy from their over watering and their plants growing over the fence lol. I tried digging holes for tomatoes, but soil near house it crap., so put them in carboard boxes after brainstorming lol figured cardboard would go hard after watering. well its all in one piece still. tomatoes ripening in a big hurry now. I reckon I left them in small pots too long, they didnt grow very high, just really bushy. Oh well.

Pool sounds good, I dug swim bag out and found shorts that fit , thats a start ha ha, so if I do convince myself to go, am ready now lol

am up for a while, cat not here for 3 days now. think got to pay some bills. nearly $2000 incl. extras got the other day, ha. thats nearly all the money I have left in day to day and internet accts.not hit up super in a while , plus scared to take more from whats left of inheritance acct. should be putting $ back in it lol..

just try and not spend $ for a while, guess. stop using car now dont have to go to adelaide wont be getting weight meds next time either.

not up to much here today. getting tyres put on car tomorrow.will walk tomorrow. from tyre place home and back guess lol thats pretty reasonable.its this side of rail line, but very long street near my old regular walking route
